These Terms of Service (“Terms”) govern your use of our website located at farmingwatch.com and any related services (collectively “Service”) operated by FarmingWatch Global Inc., located in Vancouver, British Columbia, Canada (“us”, “we”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Use of the Service

You may use the Service to browse and purchase physical products and to inquire about or purchase our digital marketing services for agriculture companies (including but not limited to social media management, paid advertising, content creation, analytics, and consulting).

You agree to use the Service only for lawful purposes and in accordance with these Terms.

2. Physical Products & Pricing

All physical products are subject to availability. All prices are in United States Dollars (USD) and exclude shipping, duties, and applicable taxes unless stated otherwise. We reserve the right to limit quantities, discontinue products, or correct pricing errors.

3. Shipping

We strive to ship orders quickly and reliably.

  • Domestic shipping (within Canada or the United States): Ships in 3–7 business days.
  • International shipping: Ships in 7–10 business days.

These are estimated timeframes based on our standard processing and carrier performance. While we do our best to meet these dates, shipping times may be delayed due to carrier issues, customs clearance, high order volume, adverse weather, or other unforeseen circumstances. We appreciate your patience and understanding.

Title to physical products passes to you upon shipment. Risk of loss passes upon delivery to the carrier.

4. Digital Marketing Services

Digital marketing services are provided on a project, retainer, or custom basis. Any agreement for services will be governed by a separate written proposal, contract, or service agreement between you and us. These Terms apply only to general use of the website and inquiries. Specific service terms (scope, payment, timelines, deliverables, intellectual property rights, confidentiality, termination, liability) will be set out in the applicable contract.

We do not guarantee specific results from digital marketing services (e.g., increased followers, leads, sales, ROI, or rankings), as results depend on many factors outside our control.

5. Orders and Payment

Placing an order constitutes an offer to purchase. We may accept or reject any order at our discretion. Payment is due at checkout. We use Shopify Payments and/or other processors — you agree to their terms.

For digital marketing services, payment terms will be specified in the contract.

6. Returns & Refunds

We do not offer returns, refunds, or exchanges on physical products once the order has been placed and processed. All sales are final. Please review product descriptions, sizing, and details carefully before purchasing.

Digital marketing services are generally non-refundable except as explicitly stated in the specific contract.

7. Intellectual Property

All content on the Service (text, graphics, logos, images, videos, code) is owned by FarmingWatch Global Inc. or our licensors and protected by copyright, trademark, and other laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or use any content for commercial purposes without our prior written consent.

If we provide digital marketing materials (ad creatives, reports, strategies), ownership and usage rights will be specified in the service contract.

8. Privacy & Tracking Technologies

Your use of the Service is also governed by our Privacy Policy (farmingwatch.com/privacy-policy).

We use cookies, pixels, beacons, and similar technologies, including Shopify analytics, Google Analytics, Facebook Pixel / Meta Pixel, and other advertising/analytics tools. These collect data such as IP address, browser type, device information, pages visited, time spent, and actions taken to improve the Service, personalize content, analyze traffic, and deliver targeted advertising.

By using the Service, you consent to our use of these technologies and the sharing of your data with the partners listed in our Privacy Policy.

You can manage cookies via your browser settings or our cookie banner (if enabled). Disabling certain cookies may limit site functionality.

9. SMS Marketing Communications

If you opt in to receive SMS messages from us, you agree to receive recurring automated marketing and transactional text messages, including cart reminders, order confirmations, shipping updates, and promotional offers.

  • Message frequency varies (up to 4 messages per month, but may be more or less depending on your activity).
  • Consent is not a condition of purchase.
  • Message and data rates may apply.
How to Opt Out or Get Help
  • Reply STOP to any message to unsubscribe from SMS marketing.
  • Reply HELP for help or more information.
  • You may also opt out by emailing us at hello@farmingwatch.com or by managing preferences in your account (if applicable).

After opting out, you will receive one final confirmation message. Following that, you will no longer receive SMS messages from us, except for important transactional updates (e.g., order confirmations, shipping notifications).

Carrier Disclaimer Carriers are not liable for delayed or undelivered messages. You agree that we are not responsible for any charges or fees imposed by your mobile carrier as a result of our SMS communications.

10. Limitation of Liability

To the fullest extent permitted by law, FarmingWatch Global Inc., its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or our digital marketing services, including loss of profits, data, goodwill, business interruption, or advertising results, even if advised of the possibility of such damages.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless FarmingWatch Global Inc. from any claims, losses, damages, liabilities, costs, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of Vancouver, British Columbia.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
